Report Infringement

TechWave Designs ("we", "us", or "our") is committed to upholding the intellectual property rights of others and expects its users to do the same. In compliance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), we will promptly address claims of copyright infringement that occur through our services, provided that such claims are reported to our designated Copyright Agent as outlined in the example notice below.

DMCA Notice of Alleged Infringement ("Notice")

1. Specify the copyrighted work you believe has been infringed. If multiple works are involved, you may provide a representative list of the works.
2. Identify the material or link you claim is infringing (or is associated with infringing activity) and must be disabled. At a minimum, provide the URL of the link on our Site or the exact location of the material.
3. Include your company affiliation (if relevant), physical address, phone number, and, if available, an email address.
4. Include both of the following declarations in your Notice:
* "I certify that I have a good faith belief that the contested use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (such as fair use)."
* "I affirm that the information provided in this Notice is accurate, and under penalty of perjury, that I am the copyright owner or authorized to act on behalf of the copyright owner or of an exclusive right under copyright that is allegedly infringed."
5. Provide your full legal name and either your electronic or physical signature.

Be aware that under Section 512(f) of the DMCA, anyone who knowingly misrepresents that material or activity is infringing may be liable for damages.

Counter-Notification

If you believe that your content was removed (or access to it was disabled) improperly and that you hold authorization from the copyright owner, their agent, or as permitted by law, you may submit a counter-notice including the following information to our designated Copyright Agent:

1. Your physical or electronic signature;
2. Identification of the content that has been taken down or to which access has been disabled, along with its previous location;
3. A statement asserting that you have a good faith belief that the content was removed due to a mistake or misidentification; and
4. Your name, address, phone number, email address, a statement consenting to the jurisdiction of the federal court in Seychelles, and an agreement to accept service of process from the entity who issued the notice of alleged infringement.

Upon receiving your counter-notice, we may forward a copy to the original complaining party to inform them that we may reinstate the removed content or cease disabling access within 10 business days. If the copyright owner does not file a court action against the content provider or user, the removed content may be restored or access re-enabled within 10 to 14 business days, at our discretion.

Repeat Infringer Policy

In accordance with the DMCA and applicable laws, we have established a policy to terminate users who are deemed repeat infringers in appropriate situations and at our discretion. We may also limit access to the Site and/or close the accounts of users who unlawfully infringe upon intellectual property rights, regardless of whether they have previously infringed.
